Motors & Controls Warehouse, Inc., dba Sabina Motors & Controls (hereinafter referred to as SABINA) warrants that the equipment, under normal use and
service, will be free from defects in material and workmanship for a period of
one (1) year from date of delivery for new equipment purchases and ninety (90)
days for all service, reconditioning or repair orders. All other repairs, shall be at Customer’s
expense pursuant to SABINA’s then prevailing rates. Labor charges shall be for a minimum of two (2)
hours for each visit to Customer’s premises and portal to portal mileage
SABINA’s sole and exclusive obligation to Customer shall be
to repair or replace any worn or defective parts. SABINA makes no other express or implied
warranty concerning the equipment to client, and all implied warranties,
including but not limited to, the warranty of fitness for a particular purpose
and the implied warranty of merchantability are expressly revoked.
This warranty does not cover repairs that arise as a result
of any accident or intentional damage, whether or not said damage is caused by Customer
including but not limited to Customer’s misuse, neglect, alteration, accident
or failure to properly follow SABINA’s instructions concerning operation of the
equipment. Further, this warranty does
not cover adjustments to the equipment which are necessitated by changes,
improper adjustments by someone other than SABINA personnel or any attempted
repair or modification to the equipment by someone other than SABINA shall
terminate all of SABINA’s obligations pursuant to this warranty and the
warranty shall be deemed void and have no further force or effect. This
warranty does not apply to any equipment that has been moved from the location
where it was originally installed and is subject to the user’s normal
maintenance and care responsibility.
SABINA shall not be liable in any manner for any default or
delay in performance hereunder caused by or resulting from any contingency
beyond SABINA’s control, including, but not limited to war, governmental
restrictions or restraints, strike, lockouts, injunctions, fire, flood, acts of
nature, short or reduced supply of materials/equipment, or discontinuance of
the parts by the original part manufacturer.
SABINA shall not be deemed liable for any incidental or
consequential damages to client. Customer acknowledges that the terms contained
in this paragraph constitute the sole and exclusive warranty obligation of SABINA
to Customer hereunder.
HOW TO OBTAIN SERVICE: Call,
write, fax or e-mail SABINA tell SABINA what is wrong with the equipment. SABINA will provide service as soon as
possible during SABINA’s normal business hours, which are Monday thru Friday
from 7:30 am to 4:00 p.m. (except holidays SABINA observes). Someone must be on site at the time SABINA
visits Customer’s premises. SABINA will provide 24-hour emergency service if
required. Premium labor charges may
apply for service calls outside of normal business hours.
